The President's Security (LinkedIn)

POTUS is considered the most death dangerous job in USA. Other country set less restrictions on their leaders. The President for this text is the leader of the country.

Does We Need to Protect the President?



Indeed.

The civil process requires at least one person to make the decisions. The most highest and extreme ones are better to be made by one person, though they can be overturned by the legislative body. This modus operandi was created as yearly as the legislative body, and track back to either Elizabethian or post-Civil War times.

Therefore, the only person tasked with immediate decisions should be protected, else he cannot.

Can We?



Let's look at current defences.

Video Surveillance in Public Places



Already implemented.

Allows for an automatic face recognition, including search for early not present.

Can be done in a statictical way: only computer doing the search knows who it finds. Therefore, the others haven't the keys to do totalitarian state out of the country.

X-Ray Scanning for Dangerous Objects



Already implemented.

Allows for search of hidden objects: firearms, explosives, even knives.

Can be done in a statistical way, using machine learning.

Automotive Remote Control



Now implementing.

Allows for emergency brakes of a car or a train.

Can be done in a statistical way, using machine learning.

Secret and Overt Patrols



Always been.

Allows for human interruption of the attack.

Requires money, privilegies and organisation to enmass the manpower.

Personal Defences



Always been.

Allows for personal protection, but leaves the weak points, nevertheless.

Not a perfect solution, but can be enchanced with other defences.

Personal Firearms on Every Person



Tried, doesn't help.

Firearms requires body and mind qualities to work properly. Even then, it's better to leave it to security, and cover&duck by yourself.

What's the Potential?



No one POTUS was killed since Kennedy, and no death attempts was made since Reagan. Despite many haters of Bush, the younger, and Clinton.

Despite alleged manhunt on Putin, it hadn't reached the conclusion.

The last British PM was assassinated in 1812 year.

It tells me, it's almost completely impossible to kill a leader of the country, else during the Revolution.

Inferior Arms in D&D (LinkedIn)

There are 12 different armour types, and 37 different weapon types in PHB of the 5th edition. Of course, each of them can be magical and has different additional properties.

Unsurprisingly, some arms are inferior to other, still they exist. Why?

Fundamental RPG Systems Law



All game systems drift to be simulationistic.

There are 3 agendas, they can mix, but everyone at the table wants to be in real simulation, despite can he do his part or not.

Moreover, Internet and deconstruction of the games threat any controversial simulation.

Once again: to be in simulation you must simulate by yourself, and usually you choose the system with interesting agenda that you can simulate within as much as possible.

Chainmail



Trivia: to make chainmail by chaining the chains one-by-one manually, you need more than ten times more work than for plate. Which question the authenticity of medieval chaimails. And they are inferior to plate. Though, it's better to wear both chainmail and full plate.

Why is a chainmail ever an entry in armour table? Wait a minute.

Pre-Industrial Production



It's handmade, custom and unstable in quality.

I've got a Million Idea

You've got a million idea, so what? Go ahead and implement, why do you look at me like that?

But what exactly is your idea?

Brilliant Idea



There is brilliant ideas, or precisely, there was. An idea like that is called a major invention, and requires knowledge base and skills to just came by.

Therefore, it seems like you are not having the brilliant idea. If you nevertheless think so, try to walk to an intellectual property lawyer, and check patents on seemingly yours idea.

Need of Money



Essentially you are stuck with need of money. If you can pull it by mortgage or saving your money, this is not a problem. But do you know how exactly much money you need?

The initial investments in a service business includes, at minimum spendings, almost 50% of management expenses.

You can pull them off if you have a room for an office equiped with a computer and business software, but the only fact you use this room for a business requires the law help to comply with regional legislation.

You can cetaintly find a partner in law area, partner in tech area, and partner in executive area, but what would you do in such a business? If you do, than you can join the funds of the partners to fuel your expenses. The classification differs from 5 areas of management because we are talking partners now.

Need for Management Expenses



This includes not only salary of an executive, who can be replaced with yourself. Instead, it includes small things like accounting software, the custom company's articles...

By the way, do you know how much you can pull off the custom company's articles? You can emblaze your power over power of investors, you can make a room for future investments, or can just solve the deadlock.

Business costs might seem tremendous for an unprepared person, as they are tax deductible, and used at large scale accounts to less than 10%.

Remember, you can spend company's capital, including minimal, on assets, inventory, and salaries, as long as it doesn't reduce the accumulated value below state minimum.

The List



You will certainly need the following either offset by your partners, or bought:

Glass Ceiling in Consulting, 5 Problems (LinkedIn)

I'm really sick of mainstream Glass Ceiling articles, so here's another one. I will try to list problems keeping you under the ceiling, and you will take it with the grain of salt.

Ordinary Employees Paying Price



One of worse thing might happen to a consultant is when bill is signed by line managers or even below.

From On-Set Breakdown you should know the hour rate of a consultant is high, even when he earns the same as line employee, not manager. Therefore, the person to sign shall be the person who:
1. Earns above the rate
2. Able to perceive the good of a consultant's work.

How to deal: Take a routine to walk by to one of top managers room during your visit, and ask him to sign instead.

Refusal could be seen as the way to push you earn low.

Asking Too Low



Going along ordinary employees' babble, you might ask too low.

The problem is, most clients use price range as the first filter. And you would not get into the train.

Researching fair price could be hard, if you haven't access to advertising board of other consultants.

How to deal: Instead, do these...

1. Calculate the gain from your advices. Take clients for calculation as high as you can reach,
2. Lower the sum calculated per year twice or thrice and take as project price,
3. If there is no bids to your ask, first go on advertising, then lower further.

Not an All-In Solution



It's amazing how times more can cost a solution encompassing several consulting works. And, at the same time, how low is the risk of wrong advice.

The last is the cause why it costs more.

How to deal: Find partners in all knowledge bases close to yours. Keep business cards.

When approaching a client now, think of complex solution.

Failing to Attend Internet



Clients usually inhabit small subset of Internet, and hanging within, and take inspiration and business ideas from it.

How to deal: Find it!

Failing to Improve



One last piece is about constant improvement. Even if world progress would stop, which will not happen for at least a half-century from now, you shall achieve new heights in your career.

And since the progress will not stop, you should keep the pace.

How to deal: Find at least two blog-style sites, and numerous information based. Browse them as a routine.

Resignation as the Last Resort (LinkedIn)

Many of you have heard of Churchill resignation. Even if not, you have heard the very similiar story of your own country.

It was easily imagined a man who realises he doesn't fit the job, and resigns.

With years passed, and Information Age coming in, this process has became less common. I can now remember resignation only as the cause to take othr position.

Why?

What A Wonderful Country



What a wonderful country would be where a politician resigns when he cannot fulfil his obligation or when she doesn't agree with the order issued on her!

Isn't it?

Therefore why we live in the world where resignation is rare. Doesn't it mean we live in worse world than we can?

Subjugation Problem



If you are subjugated, the resignation might be seem a good solution for proving you were right. The routine is simple:

1. Resign, exclaiming prophecy.
2. Do ordinary life off the job.
3. Prophecy happens.
4. You are triumphed and restored to your job.
5. Or higher.

Even the leaders of a country are subjugated to the people. And it might be a good solution for them. Nope?

The main problems are:

1. You cannot be expected to gain a new job with a decent pay.
2. You cannot be expected to restore to your job, if you are proven right.
3. You might even lose fortune, being off the job.

These are the crucial problems, especially the 3rd.

This is why it's rare for the current world to see resignation often.

What are we missing



We miss certain governmental technique to protect people.

The technique doesn't need essentially be for restoring to job, or even higher, as I believe in free competition. But for governmental jobs there sure must be. Also for military or law enforcement, where you cannot expect the free competition.

But first of all the technique shall protect people and guarantee at least decent job in case of resignation. Which is surely not the case.

Conclusion



I really hope to see more resignation in the future. It will be a sign of a good Government arosed.

«Где товары, Зин?»

Дисклэймер: никаких реальных данных по бизнесу, как в России, так и зарубежом, у меня нет. Это просто переработка материалов из открытых источников.

Где товары?



Часто можно услышать, как неудачи непродуктового бизнеса в России связывают с высокой ставкой банковского процента. Ставка действительно высокая, 15-25%.

С другой стороны, отпускная цена завода составляет в розничной цене 20-50%, если говорить об непродуктовом сегменте. Так, что прибавка в стоимости из-за заемных средств должна составлять не более 15%, а скорее 10%.

Что поднимает вопрос: «Где товары, Зин?».

Фарго



Чтобы разобраться, придется перейти к замечательному фильму «Фарго», не сериалу. Он описывает как бы реальные события в 1987 году.

Главный герой разработал бизнес-план и обладает необходимой квалификацией. Он хочет открыть автостоянку. Видимо схватив тренд машин, которые могут ездить зимой, благодаря, например, зимней резине. Что приведет к тому, что количество частных автомобилей увеличется.

Он даже не идет в банк, похоже там ему ничего «не светит». Вместо этого, он идет к венчурным инвесторам. Которые предлагают ему 1% непонятно от чего. В отсутствии других предложений он решается на преступление.

Почему так происходит?



Бизнес стремится к монополии. Это неизбежное стремление. Если бизнес не может достигнуть монополии, то он переходит к картельному сговору. И то, и другое преследуется по современным законам.

Соответственно, если бизнес в состоянии навязывать маржу венчурным капиталистам, он будет навязывать. И очень сложно найти инвестора, который сможет предложить больше 1%.

Как это ломали?



Ломается такая система, обычно, именно нелегальной деятельностью, проще говоря, преступлениями. И преступные схемы с выкупом неоплаченных опционов, и залоговая приватизация в России, и деньги от наркобизнеса, помещаются на одной линии.

Выдрав, другое слово трудно подобрать, деньги, и вложив их в бизнес, вчерашние преступники быстро превращаются в обеспеченных буржуа. Над котороми, тем не менее, висит дамоклов меч преступных доходов.

И «старые деньги» Европы, тоже, происходят из операций в Золотой век пиратства.

Новая формация приходит на смену старой, и, наверное, единственная причина, почему сейчас так просто получить венчурные деньги, состоит в том, что формаций выдвинулось несколько и они конкурируют друг с другом.

Так где же товары



Причина, почему в России не производят товары, кроется в событиях 2003-го года.

Бизнес постоянно боится потерять вложенные деньги. Но больше этого он боится, что вложенные деньги вместе с технологиями перейдут кому-то другому.

Именно это и произошло с ЮКОС'ом в 2003-ем году. Можно долго обсуждать была ли в этом вина топ-менеджмента и владельцев ЮКОС'а, но я считаю, что раз суд Российской Федерации признал вину, значит она была.

Другое дело, что на момент совершения преступления ЮКОС'ом не было очевидно, что это действительно преступление. Кроме того, подобные, но не такие, действия предпринимали позже другие корпорации и не были за это наказаны.

Система, которая поглотила ЮКОС, никуда не делась.

Какие есть способы для бизнеса защитить себя?



Есть один надежный способ защитить вложения: держать их в стране, где им ничего не угрожает.

Хм, именно это сейчас и происходит.

Именно это является главной причиной, почему в России нет своих непродовольственных товаров.

How to Screen (LinkedIn)

I got numerous questions on how to screen. This is a field guide to people under the line somewhat below Bill Gates and Elon Musk. Above, and you must know your own techniques to be succesful.

For those of you new to concept, screen is an interview teachnique, used to sieve candidates through fast. It doesn't matter who you do sieve: job appliers, consultants, potential partners, clients or else. The only thing required is their eagerness to answer your questions.

It's all about questions



Steve Balmer wants "Developers! Developers! Developers!," but you want questions and questions to ask once more.

5 Pillars



There are five important pillars:

First, make sure the answers to the questions are useful to your process.

Second, change the questions, as they are prone to spoiling.

Third, ask the same questions every time.

Fourth, include different dificulty questions in the list.

Fifth, start from easiest, then hardest, then medium.

Example of a Good List



Good questions to a consultant seeking to give you accounting advice is:

Easy: What account number is usually assigned to equipment?

Hard: What's difference to accounting between companies limited by shares and by guarantee (Great Britian)?

Medium: What's the balance sheet equation?

And please note, they are already spoiled.

The Process



The screening process usually includes unqualified and trustworthy person to do screen from your side. It's completely enough for this person to just write down replies in the blocks after asking questions.

Additionally, you can video the screen. But it's surely a Personal Identifiable Information (PII). The responses depending on the personality infused in the answers could be too, but ask your lawyer on this matter, it differs between countries.

Then check the answers. You will soon find a pattern of bad replies. Good ones could be tricky, so don't hesitate to use Internet to prove the answers.

After you found the pattern it should take no more than 3 minutes to surf through each list of replies. Which is pretty low given the batching. Batching means you could not waste you time to greetings, farewells, waiting, and changing tasks.

All materials containing PII shall be destroyed at the end of the process.

What could go wrong?



First, the spoiling. Not always the great answers to all the questions indicate spoof, but much frequently.

Second, your inability to interpret answers. Superb answers seem strange at first glance, as usually contains either recounting of many cases, or a suprise answer.

Third, the police could break into the room if you are living in Russian Federation.

Here are quick Q&A.

Is it fast?



Good list, delegated to right person could indeed save you a lot of time. You might not notice it at first, as you now process 10 to 50 times more applicants using the same timeframe, but it drastically improves the quality of outcome.

Is it legit?



Any notes taken during the interview with a person you have no contract with could be considered PII that you cannot hold in some countries, depending on the content, and shall be destroyed at the end of the process.

Additionally, there could be assault, or political or religous incorectness, so choose the right person to do screen, and instruct to speak only the routine. Choosing questions to the list could also help.

Beyond that, I don't know yet any obstacles stopping you from doing the screen.

I'm alone in the business, who to delegate?



Then the first screen done by you should be to hire the assistant to you. Business cannot be done alone. Consulting could.

What if I got not a decisive results?



Throw couple more questions in. Screen new candidates in two waves: with old, and new questions.

And remember: Screen cannot reduce number of candidates to one. The purpose is to reduce for 5-25 candidates.

Diagnosis by the phone

It seems natural if you ask consultant over the phone an advice on your problem, you easily circumvent On-Set Breakdown?

Not so.

Problem One: At Distance Meaning Verbal-Only Communication



There are consultants who use one verbal channel of communication, but they take times more time to get into your shoes. Of course, if you wield over the phone a consultant who knows you well, you can use only verbal communication. But why isn't she on salary then?

What I do: I'm trying to get into silent room before conversation, and to concentrate as much as possible on every melody (as I'm deaf to tones) of the chatter.

Problem Two: At Distance Meaning Cannot Get a Peek



What more in it, is the thing the consultant over the phone cannot get a peek on your surroundings. What means he must relate to your recourse of the situation. Which is not always correct point-to-point, isn't it?

You might even don't know this and this thing are of high importance.

What I do: I'm always trying to ask simple question after each exchange just to make sure we are still on the same boat.

Problem Three: There's no Sureness in the Answer



Giving above, it's completely impossible to insure the answer, as you as the client always expect from a consultant.

Indeed, if the problem is solved at instance of a call, say, you finally made the transaction or found the stocks ticker, it is insured, isn't it?

Not so, it could be not the best or even the right answer and it's impossible on consultant's side to determine these.

What I do: I always act a walkie-talkie and do the line: "It's not completely sure, and could be fixed as proved if I can make a visit to you." It's not an extreme marketing as many think, just a customer service.

Why people afraid to invite over the consultant?



It seems to me like there is huge, tremendous, not to say more, stratification by quality among consultants. And price tag doesn't help.

In such environment, many, after one or two mistakes, prefer to go on by trying and talk to as many consultants as possible. Which, in turn, produce aforesaid results.

It's better to screen consultants before, and then invite over. Which is hard, because not many business captains can screen.

Scarce v. Rich (LinkedIn)

Russians has repeated proverb "a man with a full belly thinks no one is hungry", or talking Biblical, Matthew 19:24, Mark 10:25, Luke 18:25, almost the identical: "It is easier for a camel to go through the eye of a needle, than for a rich man to enter into the kingdom of God."

It's already funny, there's no John quote in the stock. As figurative and symbolical John could easily be imagined saying these words.

Possibly, because it's not an easy problem, let's name it: scarce versus rich, and even ordinary burger can be considered having rich conditions, while high-ranked military officer is deemed scarce.

Once again, it's really hard to one-sider to comprehend another one. If you hear about some strange decisions, please, remember this article.

I will overlook the sources of scarceness and richness, in brief.

People



The most valuable resource.

A land where no people are A-graders, or, in contrary, where there's many of those, can easily be imagined.

In second case, there would be strict or possibly whim-like conditions on promotion. Which is not always good. So this land can be viewed as place of opportunity to open business, or, inverse, as doomed land with cacocracy.

In land of first case, subsequently, can be as well doomed by poor minds, or rejoicing the foreigners and growing with stern discipline.

Surplus in people is deemed harmful, unless you can force laws to work less hours a day, and still the people would be highly competitive to each other, as hardly anyone wants to do a cleaning job having lawyer diploma.

I will reject the urge to connect this observation with real world lands.

Knowledge



Knowledge is a resource too. Wield it and you are up to do hard work.

But in young age you cannot expect to have much knowledge, nevertheless keen mind can achieve success in young age. So what scarce of knowledge prevents?

It deems the scarce person to do try-and-repeat to achieve the same, the knowledge. It could be costly in terms of competitive strategy.

Surplus of knowledge is almost always harmless, unless you are afraid of the world you could see now.

Money



The most trickiest of resources.

What can you do if you haven't money to pay for Internet, for rent, for car? Possibly, I won't be ever writing this articles if I haven't Internet access. Still, I'm unable to pay my rent, and forced to share the flat.

If you have much more money, you can hire a maid, saving you up to 3 hours each day. You can outsource half of your work, if you haven't already. If the last, you are already rich in money.

Big surplus in money brings opportunities and problems of their own. You could be forced to fasting security measures, or hire experts to deal with your problems every other day.

Position



The strange resource.

As Revolution theorists frequently note: "Just order as you have full power, and they'll obey."

Though, it's hard to command spontaneously not in a big mess, the Revolution is like. There are always chain of command known to the most, and punishment force to return the river in its banks. So the position is a resource.

As scarce position problems are now clear, forward to rich ones. First, quoting Spider-Man, with big power comes big responsibility. Second, big position eats time in bulks. Third, there's efforts to keep the status quo.

Surplus in position could be deadly, as falling from the pyramids top could be deadly. Could not. I don't know what of two Viktor Yanokovich is example.

Conclusion



It's simple: before giving advice or judge someone, make sure you know his scarces or riches.

Freebies in Consulting, take 2

When you just cannot give it away

Can you imagine going to a physician, and not paying a thing? Oh, well, ObamaCare pays for you.

It's harder than just a mental exercise. Any consultant can work for free, as words doesn't cost a thing, but would he?

There's fixed cost of nourishing, lodging, self-improving, entertaining, and profiting. These are essential to every man or woman. And they must be paid. The last constitutes consulting cost.

But could I lower the price?



Nope.

Firstly, you train your customers to pay low, to beg discount, or to pose cheap. The price could varies on the income of a customer, but it's must be based on real data, not just overlooking the dress.

Secondly, any variation in price shall be preferably paid by some being. Else you could easily run into unpaid bills for you.

Once again: it's really bad to drop the price. Whether you are a single person or a company. It hurts the business and doesn't pay your bills.

Another question is how to set the price (as it could float to the extremes.) It's best to know the market, your place on this, and your concurrents. But it is perfectly huge topic, I cannot answer in this article.

Customer Service



Sometimes consulting is posed as a customer service. What's the difference?

Firstly, it's pre-paid in bundle with other products. This means limits on time and efforts spend on single customer. They may be pretty high, compared to literal price of a unit, but the head office ordering Customer Service shall take measures to not overbook.

Secondly, it's sold by Freebies in Real Production rules, as part of a unit. Even if unit is Intellectual Property as Windows 10, the Customer Service cannot be free off the charge. Someone must pay.

Happily, there are always many sides interesting in Customer Service, and it almost always possible to find one to pay. But the restrictions on the customers might be set.

Dip into Intellectual Property



What if you would built a database with automatic search by question, and sell it?

Viola, you are on IP side of freebies now. And can distribute it for free (for some.)

Essentially, every teaching on juniors, writing a spec or an instruction, or recording a primer, is a dip into IP. And this is exactly how consulting can lower the price.

Conclusion



If you do consulting, never drop the price.

I said before, and I'll repeat: someone must pay. Unless, you step into IP side. In this case make sure a consumer is informed that it isn't customised, neither precise, and customised and precise can be found at your office.

When you can put it on sale

Today Microsoft sells Surface Book and Surface Pro 4 with a discount, dropping as much as £195. It's not Black Friday, definitely. But a drop nevertheless.

Why do they do it? I think, you agree with me, not only out of generosity. Let me dig down.

The drop relates to cheaper models. Black Friday sale related to more expensive ones. Obviously, the sale is trying to cover all the consumer segments, so everyone wishing for precise model can buy it with a discount eventually. Or, by other angle, Black Friday one had sold gross of units and someone in consumer world noticed it, going to buy what they want. Rich ones get it without discount, and upstart get it cheaper.

Why is it ever possible?



Well, Surface units don't grow on trees like Intellectual Property, isn't it?

One of first economy University lesson, at least for me, is that there are peaks of ideal production on cost-per-unit to unit number graph. So it is more viable to produce, say, 35m of Surfaces Pro 4 or 46m, than 40m.

The surplus goes to sale.

Essentially, Microsoft loses around 20% off the charge, but saves around 30% in production costs.

It's simple: you either cargo up 3 freighters, than 3 and a half more and running around dividing loading and unloading with ABB. And transporting costs is production ones too. Count in shipping, they too have peaks of ideal production (fourteen-and-half logistic centres or just fifteen?)

Fixed costs arithmetics



Time to fixed and variable costs to enter. Wikipedia says fixed cost consist of salary and rent, and has a nifty graph displaying total cost calculation, which has absolutely no relation to the real world as there's no peaks of ideal production.

In reality, majority of fixed cost consists of lease, price of units of other manufacturers, property tax and management and consulting fees. They are called "fixed" as paid non-dependent on what production goes into the facility, if some at all.

But you probably say: "I can lease surplus factories and freighters!" Yes, this where peaks of ideal production comes from, we have discussed it in the previous section.

Variable cost on one production line of a facility is almost always proportional to the numbers of units produced. But only by the matter of one production line. When lines are combined, the peaks arises. And problems too, that's why you will need management and consulting fees if go to production.

There's not an easy question: do you need to lower fixed cost and rise variable ones of vice versa? First gives you unit stocks, the second rises cost of a unit and gives you greater operability.

But nevertheless you are able to set some off the charge.

Service is taken in account



Though, there's one more component of the equation: the service fees to you.

Microsoft Store has Microsoft Complete in. What it is? Extended warranty covering free lessons and free replacement, I got it.

But what it really is? An Intellectual Property! Sold in bundle. That's why Microsoft allows a customer to buy Surface Pro 4 without it as I told in Freebies in Intellectual Property.

Wait! It has price close to the discount! So Microsoft, essentially offers a customer to buy Microsoft Complete for free.

As I explained in Freebies in Intellectual Property, the IP has not term to wear down. And the real production unit has. So service allows to you to rule over the life-cycle of a unit.

Conclusion



Don't be fooled by comparison of Windows 10 and Surface Pro 4. Thise are different products. First is IP, second is real production. They are sold in one Store, but the price policy is completely different in both cases.

Betrayal

Many people talk about how betrayal is bad, but what it really is?

What cannot be considered a betrayal



First, war. When armies clash, either on battlefield or in convention centre, it's essential to consider the right to fight the enemy.

Else you, the reader, shall be complete pacifist, which I guess, not a case.

And it's clearly oathbreaking in "kill not" sense.

Second, civil war. I don't need to explain it to USA readers, definitely. And to UK (not GB,) considering Fourth English Civil War.

Though, it's clearly oathbreaking in both cases.

Third, squall. Even worse would be if the adversarial comes unanswered, by many moral laws system it equals to pleading guilty.

Though, it may be oathbreaking in respect the authority case.

Fourth, retribution. If you were robbed, it's your right to petition for accusation and the return, or, in case of law of prairie, to take back your goods and punish the infringer.

What is a betrayal?



It's a hate crime. Not undermining (though it's too a pity), but crime out of hate and little else.

Pure hate, not retribution, leads to betrayal.

Betrayal is always covert, as if everyone hates you, it's a war.

And it's always going to bring pain, as it's a purpose of hate, not a squall. The pain is made inevitable, and part of hate, by which hater reliefs.

Журнал должен заполняться от «лидов», как в CRM.

То есть ссылка на план урока. Там тема, домашка, педагог[и], комментарий, список по плану, также ссылка на шаблон плана. Тему и домашку показать в основной форме для справки.

Далее список учеников, желательно по плану мест и выключатели на каждом, шириной с всего, чтобы отметить отсутствующих. Возможно, блокирующиеся вскоре после начала.

Для проставления отметок: кнопка, которая превращает выключатели на учениках в кнопку диалога (всплывающего снизу). Там можно поставить оценку и написать за что и коммент (именно две эти позиции).

А таблоид оставить для заучей, как отчет.

Unnecessary Lawyer (пост с LinkedIn)

By many a lawyer seems like a fireman: a litigator who remove troubles arose unexpectedly. So is redundant. Anyway, the essential laws are intuitive, so everyone knows what belong to him.

But let's look at world without lawyers:

A World without Lawyers



There was such world, which has been studied properly. First, at Ancient Greece. Second, in Medieval Europe.

Both have laws, indeed. But they prescribed punishments and procedure, rather than *modus operandi*, and other rules prescribing under what conditions the action or inaction is deemed an infringement.

Was it good? Actually, yes, from this time's point of view. It was better than not having laws.

But there was questions to answer, primarily: What portion of punishment should apply, if not a whole? Can a perfectly reasonable action be deemed inlawful, and inverse? Who is to prove?

In late realms this is was an issue to debate, but what can you do debating Pericles? An once again: on what grounds should the process reside?

The usual example is conflicting intentions: if a pedestrian walks across the road, stumbles and stand up, and there's line of carriages approaching, should first carriage stop and risk collision with the next? The answer differs in Modern times, and is decided on a whim in the world without lawyers.

A Big Change



During Ancient Rome and Renaissance England one simple thing was recognised:

It is better to have obscure, but predictable rules, than straight, but unpredictable ones.



Same times it collided with delegation issue, and the new profession, lawyer, was born.

Lawyer is not just delegation issue, neither a lawyer a litigator. Rather, the need of rules programming, on their turn required the special profession, who can discern and influence the rules.

It's not the same as SMM profession, with all due respect: law cannot be practiced by an non-professional, even at low speed. But it's perfectly fine to require a clear explanation from lawyer, after all the law is a thing of real world.

Types of Lawyers



Maxim Dotsenko has proposed great classification of lawyers in Russian. It breaks down to following:

1. Hamsters



Workhorses who dig up piles of documents, check, recheck, do law work as part of manager work, and else. Don't able to do the whole law work, but, nevertheless, essential.

2. Peacocks



What by many understood as litigator: a person to squall and persuade. Usually, afraid of Hamsters work, but do not able to do lawyer, besides litigator, work on their own.

3. Sharks



Real lawyers. Able to lead a group of Peacocks and Hamsters, possible other Sharks, to achieve result. Finish compliance and other paper work.

4. Owls



Higher lawyers. Do templates of legal documents: contracts, other agreements, even write laws. Frequently works alone, or with help of hamsters. Does organise groups and lead them as a Shark.

Maxim also notes, that, to be successful at a tier, a lawyer should learn skills from all the previous.

My Very Unprofessional Opinion on Juries



Jury practice was created in Renaissance England as an instrument to promote Civil Society and an evolution of Trial by Combat.

It was successful in this times of desert of laws describing test of facts. The more develops the last, and more Jury was put under treat of punishment for unlawful decision, the more its actions become dependant on presiding Judge's words.

Also, the procedure of choosing had its influence. What it boils down is Judge Alsup's verdict (not Jury, which he influenced almost in any event) in Oracle v. Google case, creating precedent of not protecting API of code. Counting in the implied permission to "steal" the code by fully rewriting it, but preserving all the features, it is tremendous! It has reverted previous decisions, and later would be reverted. Does such thing is what we need from the Jury?

What could be, in corporate procedures, is business captains acting as Jury. They really could request lawyers an explanation, and judge on the legal grounds. But, anyway, they would not show up due to possible punishment for inlawful decision, and the nation has professionals to do the same job!

What it's in reality is PR machine acting as Jury and shifting the precedent to the public opinion.

Ещё про преподавание

Есть такая школа — ЛОГОС. Когда начался бум в IT (бакс вырос) чуваки поняли, что надо бы лохов разводить (разносчиков пицц) и создали школу. Сейчас уже немного поднялись, хорошее помещение имеют и всякие мероприятия организовывают. Но срать на это нужно. Основное в любых школах\курсах — это блеать преподаватели. Хуйня видел кухню изнутри. Сначала были более-менее адекватные мидлы, которые могли что-нибудь донести. Но последние 2 года — дети. Преподаватели — без опыта.

Может кто из них уже и работает, как джун на какой-нить галере. Но много кто начинал с преподавания. Это ппц. Как человек без опыта может учить другого?! Легко — приходи на говнокурсы и поймёшь как.
